Real Robot Terms

These terms apply to the purchase and use of the PhysiCar real robot, generation 1 (the "Real Robot"), sold by AI Castle Inc. (the "Company"). The PhysiCar AI cloud service is governed by the Terms of Use and the Privacy Policy; these terms prevail on matters concerning the Real Robot itself.

Read before use

  • For ages 14 and up; under 14 only with direct adult supervision. Contains small parts and a rechargeable battery — keep it out of the reach of children.
  • Charge only with the supplied charger, with the battery removed from the vehicle and inside the supplied fireproof charging bag (LIPO SAFE). Never disassemble, puncture, crush or overheat it; stop use if it swells, deforms or overheats.
  • See Safety Precautions below for the full list.

1. Scope and Acceptance

  1. These terms cover the generation 1 Real Robot sold by the Company and the accessories supplied with it. Separately sold tracks, fences and accessories are governed by their own conditions of sale.
  2. By using the Real Robot you accept these terms. If you do not accept them, do not use it and return it under Article 4.
  3. The Company may revise these terms and will publish the revision and its effective date on this page. A purchase is governed by the terms in force at the time of that purchase.
  4. The Real Robot may be sold by the Company directly, through online marketplaces on which the Company sells, or through resellers the Company has authorised. For a purchase made through a marketplace or reseller, returns, refunds and delivery follow that channel's own procedure and policy, and must be requested through it.

2. Definitions

  • Real Robot — the product in Article 1(1) together with the accessories supplied by the Company.
  • Service — the online services the Company provides at physicar.ai and its subdomains.
  • Software — all software installed on the Real Robot or supplied by the Company for it, including updates.

3. Purchase and Contract

  1. A contract of sale is formed when the Company accepts your order and payment is completed.
  2. The Company provides the written particulars of the contract no later than delivery. Where the law permits, product labelling stands in for a written particular.
  3. Where a contract is made with a minor, the minor or their legal representative may cancel it unless the legal representative has consented.
  4. Purchases from a seller the Company has not authorised are not covered by the warranty and return provisions of these terms; that seller's conditions apply.

4. Withdrawal and Returns

  1. You may withdraw from the purchase within 7 days of receiving the Real Robot. If you receive the written particulars later than the goods, the period runs from receipt of those particulars.
  2. If the Real Robot differs from its description or advertising, or the contract is performed differently from what was agreed, you may withdraw within 3 months of receipt and within 30 days of the day you learned or could have learned of that fact.
  3. Withdrawal is not available against the Company's wishes where:
    • the Real Robot was lost or damaged through a cause attributable to you, except where packaging was opened to inspect the contents;
    • its value fell substantially through your use or partial consumption; or
    • its value fell with the passage of time to the point where resale is difficult.
  4. Return shipping is borne by you for a withdrawal under paragraph 1 and by the Company for one under paragraph 2.
  5. The Company refunds the price within 3 business days of receiving the returned Real Robot.
  6. A return after the statutory withdrawal period is accepted only with the Company's prior agreement, only for an unused product in its original packaging, and net of a restocking charge.
  7. Paragraphs 1 to 6 do not apply where a business buys for commercial purposes; the conditions individually agreed between the Company and the buyer apply instead. This exception does not apply where the business buys on the same terms as, and in substantially the same position as, a consumer.

5. Limited Warranty

  1. For one year from the date of purchase, the Company will repair, free of charge, defects in materials and workmanship arising under ordinary use.
  2. The following are consumable parts that wear with ordinary use, and are warranted for six months:
    • battery and charging cable;
    • drive motors, steering servo, pan and tilt servos;
    • tyres and wheels;
    • gears, gearbox and other drivetrain parts;
    • suspension parts;
    • cables and connectors;
    • chassis covers, bumpers and other exterior parts.
  3. Ordinary wear of consumable parts is not a defect. Battery capacity declines naturally with charge cycles and that decline is not a defect.
  4. This warranty runs to the original purchaser only and is not transferable. Where proof of the purchase date is not available, the date of manufacture applies.
  5. The Company will, at its option, repair, replace with an equivalent product or part, or refund all or part of the price. A repaired or replaced part is covered for the remainder of the original warranty period.
  6. The following are excluded from the warranty:
    • mishandling, dropping, liquid ingress or contamination;
    • use of a charger or other equipment of the wrong specification not supplied by the Company;
    • disassembly or modification of the hardware, or repair by anyone the Company has not authorised (modifying or reinstalling the Software is not in itself excluded; only faults caused by it are);
    • use or storage in unsuitable conditions such as high heat or humidity;
    • cosmetic damage;
    • use in a rental or leasing business, or use in breach of Article 6(3).
  7. The Company does not offer a paid repair service. For a failure after the warranty period, a failure falling under paragraph 6, or any other failure this Article does not cover, the Company is under no obligation to repair, supply parts or replace, and you will need to purchase a replacement product. On that basis the Company does not maintain a separate parts-retention period.
  8. Back up your data before sending the Real Robot in for service or replacement. Data may be erased or reset in the process and the Company is not responsible for that loss.

6. Permitted Use and Software

  1. The Real Robot may be used for personal learning, education, research, development and testing.
  2. Software that the Company publishes under the PhysiCar Community License (such as physicar-ros) may be used under that license, and where this Article conflicts with it, the license prevails for that software. For other Software (such as the PhysiCar extension), the Company grants a non-exclusive, non-transferable, non-sublicensable and revocable licence to use it to the extent needed to run it on the Real Robot, and any end-user license agreement supplied with that software also applies. All rights not expressly granted are reserved to the Company and its licensors.
  3. You may not:
    • operate a rental or leasing business with the Real Robot (letting participants of your classes or events use it is not a rental business);
    • use the Real Robot or the Software to develop a competing product or service (in the sense of "Competing Offering" in Section 1 of the PhysiCar Community License);
    • defeat the authentication, genuine-product verification or safety mechanisms of the PhysiCar platform; or
    • use it unlawfully or to infringe the rights of others.
  4. The Real Robot is not designed for use in hazardous environments or to control critical systems.
  5. The Company may provide maintenance, bug fixes and security updates for the Software. Updates are optional; you may stop or delay automatic updates. Each release states the license version that applies to it, and if a license revision is more restrictive, the Company gives 30 days' notice before delivering it through automatic updates.

7. Service Dependency and Discontinuation

  1. The following work without connecting to the Service:
    • power, driving and manual control;
    • the robot's on-board web console and development environment;
    • running your own code and models stored on the robot.
  2. AI chat, voice conversation, credit-consuming features, classroom integration and over-the-air update delivery require the Service and a valid account, and are governed by the Terms of Use.
  3. The Company may change or discontinue all or part of the Service where:
    • maintenance or replacement of equipment makes it technically necessary;
    • a force majeure event such as a natural disaster, power failure or network outage occurs;
    • a change in law or a regulator's requirement makes it necessary;
    • the Company ceases business or ends provision of that Service; or
    • there is another substantial reason why the Service cannot be continued.
  4. Where the Company ends provision of the Service under paragraph 3(4), it will give notice at least 30 days before the end date, on this page and to your registered contact details. Where advance notice is impossible, notice will be given without delay once the cause is resolved.
  5. Where discontinuation leaves features outside paragraph 1 unusable, the Company will refund the price of Real Robots bought in the 6 months before the discontinuation notice and refund unused credits. This is your sole remedy for discontinuation of the Service.
  6. Paragraph 1 describes the current design and is not a guarantee of future operation.

8. Data and Personal Information

  1. The Software may send the Company information about the Real Robot's condition and use, including available memory, uptime, logs, network diagnostics, connection status and software version. That information is handled under the Privacy Policy and may be processed and stored on servers outside the Republic of Korea.
  2. If you record other people with the robot's camera or microphone, you are responsible for informing them, obtaining any consent required, and complying with applicable law.
  3. You are responsible for how data you collect with the Real Robot is handled.

9. Disclaimer of Warranties

  1. The limited warranty in Article 5 is the Company's only warranty for the Real Robot hardware; no other warranty appearing in printed or online material applies.
  2. To the fullest extent permitted by law, the Software and the Service are provided "AS IS" and "AS AVAILABLE", and the Company does not warrant that they are accurate, uninterrupted, error-free, or fit for a particular purpose.

10. Limitation of Liability

  1. The Company's liability is limited to ordinary damages and, in amount, to what you actually paid for the Real Robot.
  2. To the fullest extent permitted by law, the Company is not liable for indirect, special or consequential loss, loss of data, or loss of business opportunity.
  3. Paragraphs 1 and 2 do not apply to the Company's intent or gross negligence, or to death or personal injury. Where applicable law does not permit a limitation of liability, that law prevails.
  4. The Company is not liable for loss arising from force majeure, from a cause attributable to you, or from use in breach of Article 6(3).

11. Your Indemnity

If a third party brings a claim against the Company arising from your use of the Real Robot, your breach of these terms, or what you build or collect with the Real Robot, you will defend the Company at your own cost and indemnify it against the resulting loss and expense. This does not extend to any part of the claim caused by the Company.

12. Suggestions

The Company may use, without restriction and without compensation, any suggestion you make for improving the Real Robot, the Software or the Service.

13. Export and Compliance

You must comply with the export, import and sanctions laws applicable to your use and movement of the Real Robot and the Software, and must not export or supply it to any country, person or use those laws prohibit.

14. Termination of Rights

Your rights under Article 6 terminate automatically, without notice, if you fail to comply with these terms. The Company's failure to act on a breach immediately is not a waiver of its rights.

15. Governing Law and Disputes

  1. These terms are governed by the laws of the Republic of Korea, and dispute resolution and jurisdiction follow Article 15 of the Terms of Use. Where you are a consumer, the mandatory jurisdiction and choice-of-law rules of your country of residence prevail, as do any more favourable rights that law gives you, and the corresponding provision does not apply to that extent.
  2. If any provision is held invalid, the rest remain in force.
  3. You may apply to the Korea Consumer Agency for mediation of a consumer dispute under the Framework Act on Consumers.
  4. A dispute with a buyer resident in the United States will be resolved by binding arbitration under the Consumer Arbitration Rules of the American Arbitration Association, rather than in court, except for claims that qualify for small claims court. Arbitration will be conducted on an individual basis only and not as a class, consolidated or representative proceeding. For any claim that proceeds in court rather than arbitration, both parties waive the right to a jury trial.
